Late Payment Law The Late Payment of Commercial Debts (Interest) Act 1998 has two purposes. Firstly, to compensate creditors for the late payment of debts. Secondly, to deter late payment. It only applies to the commercial supply of goods and services where you don't have a provision for interest in your Terms of Business.
In brief, for invoices that are not paid on time, it enables you to claim interest, compensation and (for orders placed after 16 March 2013) your reasonable costs of collecting the debt where these exceed the compensation. Letter Before Action A Letter Before Action is a formal letter which sets out what is owed from a debtor to your business. It gives your customer a set time period - usually 7 days - in which to pay. Before issuing any legal proceedings a Letter Before Action must be sent or costs may be forfeited.
A Letter Before Action is an essential requirement of the debt recovery process. The LBA requests payment of the debt to your business, and warns of the imminent issue of a court claim together with additional interest and costs.
